This protest was the culmination of an intellectual and political evolution more than a decade in the making. This book examines the debate over digital copyright, from the late 1980s through early 2012, and the new tools of political communication involved in the advocacy around the issue. Drawing on methods from legal studies, political science and communications, it explores the rise of a coalition seeking more limited copyright, as well as how these early-adopting, technology-savvy policy advocates used online communication to shock the world. It compares key bills, congressional debates, and offline and online media coverage using quantitative and qualitative methods to create a rigorous study for researchers that is also accessible to a general audience.

About the Author
Bill D. Herman is an Assistant Professor in the Department of Film and Media Studies at Hunter College, City University of New York. He earned a Ph.D. from the Annenberg School for Communication, University of Pennsylvania, in 2009. His work has appeared in journals such as the Yale Journal of Law and Technology, the Journal of Computer-Mediated Communication, Communication Law and Policy and the Federal Communication Law Journal.

An overview of copyright politics at the turn of the century.

The Fight Over Digital Rights is a book about politics of copyright in the United States. Although there are many works covering the legal or the economic side of the copyright debate, few are political in nature and fewer still as comprehensive as Bill Herman's work. The book sets out to do three things in three distinct parts. The first 80 pages give an overview of the political history of digital copyright from the Audio Home Recording Act (AHRA) to and after the Digital Millennium Copyright Act (DMCA). This part gives answers to important questions concerning policymaking and lobbying in the 80s and 90s. The second 80 pages outline the political communication in the Congress, in Print and Online. This is the key contribution of the author and the one that is otherwise most difficult to summarize for the non-expert audience. The third part is a discussion of the present and future of copyright including the digital rights management, the PIPA and SOPA, their (temporary?) demise, and the potential for future copyright advocacy.

There are at least three reasons why the book is a success. The first is that the author recognizes that the only way to understand and legitimately manage the modern debate and policy making in intellectual property is to understand its (political) origins. The second is that relevant empirical evidence is used in second part to substantiate the claims the author raises and deepen our understanding of how public discourse influences lawmaking. The third relates to the title itself. As massive demonstrations against SOPA and PIPA in the United States and against ACTA in the EU have shown, copyright is also something that can be influenced by the general public. This book gives clues about how that can be done.

Well-written but a narrower than the title sounds

This is a well written book about the intense politics around copyright around the turn of the 21st century. It focuses especially on digital rights management (DRM), the Digital Millennium Copyright Act and its aftermath. The author uses a communications approach to analyze this movement, but he doesn't bore you with communications talk. A nice, light touch with the methodological armature.

Two complaints:
The tone can be a bit overblown: He's an enthusiast for the Fair Use Coalition, and it's possible to come away thinking that the academic analysis never really interfered with the author's own predilections and biases.

Second, the author ignores many other issues in copyright, occurring around the same time, as if the DMCA was the whole deal. I'm thinking here of the Copyright Term Extension Act of 1998, and in the light of that, the increasing regret over the post-1976 removal of formalities and the US joining the Berne convention (and all that it brought with it). DRM is only one copyright issue but the author focuses on it like it's the only one. In so doing, he telescopes the range of issues at play in copyright into a battle with two sides. I don't think that is the most nuanced way to look at copyright politics today, though, judging by books on the subject, that does seem to be the dominant approach.
